    Presentation

    The Centre for Fundamental Rights and Private Law (Centre de droit privé fondamental – CDPF), (UR 1351) was founded  in 1994 by Georges Wiederkehr and headed from 1999 to 2017 by Frédérique Granet, then by Dominique d'Ambra from 2017 to 2021. Since 2022 it has been led by Marc Mignot and Magalie Nord-Wagner. The Centre for Fundamental Rights and Private Law is a member of the Europe in Motion Research Federation (Fédération de recherche L'Europe en mutation – FRU 6703). It brings together around 25 teacher-researchers specialising in civil law, criminal law and procedure, private international law and civil procedure, and around 30 PhD students.

    Several majors and master's degrees programmes are attached to the Centre for Fundamental Rights and Private Law and are under the pedagogical responsibility of its teacher-researchers:

    • The Private Law major (headed by Bénédicte Girard), with 5 programmes: Fundamental Private Law (headed by Bénédicte Girard), Domestic, International and Comparative Family Law (headed by Patrice Hilt), Justice, Trials and Procedures (headed by Sylvie Pierre-Maurice) and Comparative Law (headed by Nicolas Nord)
    • The Law major (headed by Bénédicte Girard) with the Cyberjustice programme (headed by Bénédicte Girard and Emmanuel Netter)
    • The Criminal Law and Criminal Sciences major (headed by Jocelyne Leblois-Happe), with 3 programmes:  Criminology (headed by Magalie Nord-Wagner), Applied Criminal Law (headed by Jocelyne Leblois-Happe) and Fundamental and Comparative Franco-German Criminal Law (headed by Jocelyne Leblois-Happe)
    • The Notarial Law major (headed by Eric Sander and Patrice Hilt)
    • The Heritage Law major with the Legal and Tax Engineering programme (headed by Estelle Naudin and Nicolas Kilgus)

    Research topics

    • Topic 1: Civil Law and Civil Procedure, headed by N. Kilgus and S. Pierre-Maurice
    • Topic 2: Private International Law and Comparative Law, headed by S. Fulli-Lemaire
    • Topic 3: Criminal Law and Criminal Procedure headed by J. Leblois-Happe
    • Topic 4: Legal History, headed by C. Drand

    In addition, the members of the Centre for Fundamental Rights and Private Law have chosen 2 cross-disciplinary research topics, the first relating to Vulnerability, headed by D. Porcheron and P. Hilt, and the second on the Acceleration of Justice, headed by S. Pierre-Maurice.

    Major events and works

    Mathieu Moreau-Cucchi's thesis on "The jurisdictional responsibility of the arbitrator" under the supervision of Professor Christophe Seraglini won the prix Philippe Fouchard awarded by the Comité français de l'arbitrage.

    The CDPF launched the research cycle entitled "Les défis contemporains suscités par le contrat de travail international – Approche comparée et transversale en droit international privé, droit de la sécurité sociale et droit de l'Union européenne", in partnership with the Institut François Gény at the Université de Lorraine, the University of Valencia's Faculty of Law and the University of Ferrara's Department of Law. The first seminar in this cycle, titled "Mobilité du salarié et transport international", was held in Strasbourg in September 2024 and receives IdEx "Congrès et Symposiums internationaux" funding.

    It was also behind:

    • The series of lectures in partnership with the Council of Europe on sexual and gender-based violence and domestic violence
    • The CDPF UR 1351 and IRCM UR 3399 colloquium, on the 19-20 October 2023, at the University of Strasbourg, co-directed by Étienne Muller and Bénédicte Girard
    • The colloquium titled, "Forces et faiblesses des mécanismes de protection de la personne vulnérable", 29 September 2023, University of Strasbourg, CDPF UR 1351, co-supervised by Patrice Hilt
    • The colloquium titled, "Les règlements européens Digital Markets et Services Acts, Aspects de droit international privé", 20 January 2023, University of Strasbourg, UMR 7354 DRES, CDPF UR 1351, CEIE EA 7307, co-supervised by Étienne Farnoux

    Many teacher-researchers from the CDPF (D. Porcheron, J. Mattiussi) are behind the creation of the OCEAN network (page in English) on the Istanbul Convention.

    E. Netter was the winner of the AAP IdEx 2024 Attractivité award for the Electronic Compliance and Regulatory Enforcement project.
